ABSTRACT
This paper integrates two analytical layers that are often artificially separated in digital political economy research:
(1) descriptive–structural analysis of platform behavior, and
(2) diagnostic–prognostic analysis of systemic risk.
Using the case of Zalo’s recent Terms of Service (ToS) update in Vietnam, the study argues that the resulting social backlash did not originate from the extent of data collection—now a global norm of platform capitalism—but from a cognitive and structural misclassification: the application of transactional consent logic to a deeply embedded social communication infrastructure.
Building upon a neutral structural analysis, the paper develops an early-warning diagnostic model to identify potential systemic risks, including forced consent mechanisms, retroactive legitimation ambiguity, and the emergence of data power that outpaces collective cognitive governance. The study does not allege legal wrongdoing. Instead, it warns that if such practices are normalized, they may establish dangerous precedents for cognitive sovereignty and non-traditional security in Vietnam’s evolving digital legal regime.

- INTRODUCTION: WHEN TERMS OF SERVICE BECOME A POWER EVENT
In most digital economies, Terms of Service (ToS) are treated as technical documents.
However, when a platform functioning as national-scale communication infrastructure imposes an “accept all or lose access” condition, ToS cease to be technical instruments and become economic, legal, and cognitive power events.
The central question of this paper is not:
“Does Zalo collect personal data?”
because data extraction is a structural condition of platform capitalism (Srnicek, 2017; Zuboff, 2019).
The correct analytical question is:
Why does the same data logic provoke radically different social reactions when applied to a social communication infrastructure rather than to transactional platforms or global Big Tech? - NEUTRAL STRUCTURAL BASELINE: DATA AS A SYSTEMIC NORM
There is no empirical evidence that Zalo collects personal data beyond international industry norms in quantitative terms.
Accordingly, framing the event as an ethical anomaly or data greed is analytically unsound.
The social conflict emerged not from how much data is collected, but from:
how data power is legitimized,
during a legal transition phase (Vietnam’s Personal Data Protection Decree and forthcoming data laws),
within a society lacking mature cognitive frameworks to distinguish different categories of platform power.
This descriptive layer establishes the epistemic safety zone necessary for rigorous analysis. - PLATFORM COGNITIVE MISCLASSIFICATION: TRANSACTION ≠ COMMUNICATION
3.1 Transactional Platforms and Explicit Legitimacy
Financial and transactional platforms (e.g., digital wallets, banking apps) operate within:
asset risk,
explicit legal obligations (KYC, AML),
conscious, instrumental decision-making.
Here, privacy trade-offs are contractually explicit and cognitively framed as transactions.
3.2 Communication Infrastructure and Implicit Social Trust
By contrast, messaging and calling platforms function as:
private social space,
relational infrastructure,
emotional and identity-bearing environments.
From a cognitive neuroscience perspective, these domains predominantly engage the Default Mode Network (DMN), unlike the Task-Positive Network (TPN) activated during transactional behavior.
Applying transactional consent logic to a social communication infrastructure constitutes a category error—a structural misclassification of power. - BEHAVIORAL DIAGNOSIS: FORCED CONSENT AS A RISK SIGNAL
In organizational behavior and criminological psychology, abrupt changes in modus operandi often signal:
time pressure, or
strategic realignment.
The shift from implicit data collection to explicit coercive consent (“accept or lose access”) should be interpreted as a behavioral symptom, not as proof of wrongdoing.
From a social neuroscience perspective, such design:
threatens social disconnection → activates TPN survival responses,
suppresses DMN reflective capacity,
reduces ethical deliberation under perceived digital threat.
This mechanism can be analytically described as cognitive forced consent, or at the modeling level, cognitive hostage-taking. - MOTIVE ANALYSIS AS CONDITIONAL RISK HYPOTHESES
5.1 Retroactive Legitimation Ambiguity
Legally, consent does not possess unlimited retroactive force.
Thus, no ToS update can automatically “launder” historical data.
However, the public emergence of this suspicion indicates:
erosion of social trust,
communicative failure in data governance,
a cognitive legitimacy gap.
This is a risk perception indicator, not legal evidence.
5.2 Data, AI, and Strategic Positioning
A more plausible hypothesis concerns:
consolidation of existing data processing rights,
training Vietnamese-language AI systems,
maintaining competitive advantage against Big Tech entrants.
The issue lies not in technical objectives, but in the absence of proportional ethical framing and cognitive governance commensurate with such power. - PROGNOSTIC RISK ANALYSIS: IF NORMALIZATION OCCURS
6.1 The “Zombie Data Fortress”
Even after user exit, historical data persist as static assets.
This enables the emergence of what can be described as behavioral archives—digital twins of society detached from living consent relationships.
6.2 Precedent for Domestic Data Colonialism
If forced consent becomes normalized, it risks:
institutionalizing coercive privacy trade-offs,
eroding citizen cognitive sovereignty,
transforming data governance into a non-transparent power domain.
These are non-traditional security risks, not issues resolvable by post-hoc fines. - CRITICAL COUNTER-ARGUMENTATION (STRUCTURAL DEFENSE)
7.1 Intent Is Not the Analytical Unit—Structure Is
The demand for proof of malicious intent misplaces the analytical burden.
Risk governance evaluates systemic capacity for harm, not moral psychology.
Requiring intent evidence to dismiss structural risk constitutes a second-order category error.
7.2 Forced Consent as Design Description, Not Moral Accusation
“Forced consent” here denotes an observable UX pattern documented in coercive design research (Gray et al., 2018).
It describes how consent is obtained, not why.
7.3 Hypothetical Risk Is Not Conspiracy
Counterfactual questioning is a legitimate policy tool, especially under regulatory flux.
Rejecting risk discussion due to lack of damage evidence contradicts the precautionary principle.
7.4 The MoMo Comparison Reinforces the Argument
Differential reactions arise from functional and cognitive framing, not inconsistency.
Applying transactional legitimacy logic to social infrastructure explains, rather than undermines, public response.
7.5 Absence of Harm ≠ Absence of Risk
In data systems, by the time harm is visible, reversibility is minimal (Beck, 1992; Taleb, 2010).
Early analysis is therefore a governance necessity, not speculation. - LIMITATIONS AND POSITIONING
This paper:
does not allege legal violations,
does not claim malicious intent,
does not assert conspiracy.
All risk scenarios are conditional, structural, and precautionary.
Refusing to analyze these scenarios is not neutrality, but a political–cognitive choice privileging short-term stability over long-term societal resilience. - SYNTHETIC CONCLUSION
Zalo’s failure was neither technological nor quantitative in data terms.
It was a failure of:
platform cognitive classification,
ethical proportionality,
interdisciplinary governance awareness.
Diagnostic conclusion:
No grounds for accusation; sufficient structural signals for early warning.
Policy implication:
Such events must be treated as cognitive power governance challenges, not communication crises.
